Thabane is appearing in the Maseru Magistrates Court after police rejected his sick leave.
His lawyer, Qhalehang Letsika, wants the court to determine if Thabane can be charged as a sitting prime minister and or if that should be decided by the Constitutional Court.
Thabane was flanked by his wife, first lady Maesiah Thabane, who's already been charged with murder and attempted murder.
Magistrate Phethise Motanyane has taken a recess to decide.
