Court sets aside suspension of Home Affairs DG Apleni

PRETORIA - The High Court in Pretoria has paved the way for Home Affairs Director-General Mkuseli Apleni to return to work.

Apleni has asked the court to declare that former Minister Home Affairs Minister Hlengiwe Mkhize does not have the authority to suspend him.

The High Court on Wednesday ruled that the minister’s decision was unconstitutional.

The court ruled that Mkhize lacked the authority to suspend Apleni and declared his suspension unlawful and set it aside. The minister has been ordered to pay the costs.

It remains unclear whether the newly appointed Home Affairs Minister will revisit the allegations against Apleni.

It is, however, understood that the director-general intends to return to work as soon as possible.
