High Court judges 'uneducated' for reducing rapist's sentence

Judges reduced a man's sentence from life to 20 years in prison because they say he only forced his stepdaughter to have oral sex with him.

JOHANNESBURG - Non-governmental organisation Women and Men Against Child Abuse says two Pretoria High Court judges are uneducated after they reduced the life sentence of a man who forced his six-year-old stepdaughter to re-enact porn movie scenes with him.

The judges reduced the man's sentence from life to 20 years in prison because they say he only forced the girl to have oral sex with him and that this did not constitute a severe rape case.

But Miranda Jordan-Friedman says her organisation is appalled by the judgment.

Judge H.R Fourie said while it was accepted that oral rape was disgusting and traumatic for the child, it didn’t result in any physical injuries or pain.

But Jordan-Friedman says this judgment is wrong.

“It is all the same as far as the long-term consequences, the betrayal and the shame. So obviously we have two very uneducated judges.”

She says it sends a message that oral rape is more acceptable.

“The fact that two judges in the High Court do not at all understand the gravity of this crime, for me, it also sends a very strong message.”

Friedman says the man's actions have handed his stepdaughter her own life sentence in a jail of trauma.
