[LISTEN] 70,000 SA phones being spied on each year
Right2Know Spokesperson Busi Mtabane says according to telecommunications companies, at least 70,000 warrants to access citizens’ cellphone records are filed in a year.
JOHANNESBURG - Right2Know Spokesperson Busi Mtabane says there is a loophole that allows law enforcement agencies to acquire surveillance of citizens’ phones through section 205 of Criminal Procedure Act, instead of the RICA law.
Mtabane says officers can lie about why they need a warrant under section 205 as the judge does not need the details of the request.
Mtabane says citizens, especially whistleblowers, should be concerned because this infringes on their safety, as the process is open to abuse.
Right2Know is calling for more clarity on whether one is being surveilled.
