SABC board probe: Legal uncertainty led to governance breakdown
MPs have suggested that many SABC board members were not properly informed about the contents of the Broadcast Act.
CAPE TOWN – The South African Broadcasting Corporation inquiry has heard that legal uncertainty contributed to the breakdown of corporate governance at board level.
The Parliamentary ad hoc committee has been sifting through the evidence before it, relating to the now defunct board's failure to meet its fiduciary duties.
Members of Parliament (MP) have suggested that on the evidence before them, many board members were not properly informed about the contents of the Broadcast Act.
National Freedom Party MP Nhlanhla Khulubisa says, “There is some kind of legal uncertainty that has played in the fiasco leading up to the dysfunction of the board, and the manipulation of this uncertainty has contributed immensely to the transparent and accountable corporate governance.”
