Madikizela-Mandela takes Mandela Qunu home matter to SCA
Winnie Madikizela-Mandela is calling for the SCA to overrule a high court’s dismissal of her application.
JOHANNESBURG - Winnie Madikizela-Mandela's legal team has confirmed the ANC struggle stalwart will be petitioning the Supreme Court of Appeal(SCA) for the right of ownership to the former president Nelson Mandela's Qunu home.
Madikizela-Mandela filed papers on Friday, calling for the court to overrule the Mthatha High Court's decision to dismiss her application.
In his will, the late statesman ordered that the home be left to the entire Mandela family.
But Madikizela-Mandela claims the house was bought while she was married to Madiba and therefore belongs to her in terms of AbaThembu customs.
Her lawyer Mvuso Notyesi said, "Properties in rural areas are subject to the customary law of the community consent. It cannot arrive that it can be included in the will because there is no exclusive ownership."
