Manqele’s legal team vows to exhaust all legal avenues
Sindisiwe Manqele’s application for leave to appeal her conviction & sentence was turned down yesterday.
JOHANNESBURG - Sindisiwe Manqele's lawyers say they remain confident of being granted leave to appeal her conviction and 12-year sentence, for murdering her boyfriend Nkululeko 'Flabba' Habedi.
Yesterday, the High Court sitting in Palm Ridge turned down Manqele's application, and her legal team will now turn to the Supreme Court of Appeal (SCA) in Bloemfontein.
Acting High Court Judge Solly Sithole dismissed Manqele's application for leave to appeal.
She was found guilty of stabbing the rapper at his home in Alexandra last year.
Manqele began serving her 12-year jail term at the Johannesburg Prison in Naturena yesterday.
But her attorney, Amanda Vilakazi, says they will fight until they have exhausted all legal avenues.
"We still believe that another court could come to a different conclusion, that she be found not guilty of murder."
Manqele stabbed Habedi in the chest after a heated argument.
She has maintained that she stabbed the musician in self defence.
Sithole said he dismissed her application because he doesn't believe that another court will have a different outcome.
Earlier in the trial, the state argued that a heated argument between the two lovers was caused by Manqele's intolerance at seeing Habedi interacting with another woman at a Sandton club.
But Manqele's lawyers said she stabbed her boyfriend to protect herself, and not because he danced with a former lover.
The defence lawyers cautioned against representations of her being a drunk jealous girlfriend who killed her musician boyfriend out of spite.
