JOHANNESBURG - Lawyers for a man accused of involvement in a Rhodes Park double murder and rape have abandoned their bail application after failing to prove that the 24-year-old is in the country legally.

Thabo Nkala appeared briefly in the Johannesburg Magistrates Court this morning where his case has been postponed.

Nkala is accused of being part of a 12 member gang that attacked two couples in Kensington last month, drowning two men and raping one woman.

Nkala's lawyer Dumisani Mabunda says his family has still not produced permits to prove that the Zimbabwean national is in the country legally.

With the bail application failing to commence today, Nkala will remain in police custody until his next appearance on 9 December.

He will be back in the dock with his co-accused, a 22-year-old suspect, who was arrested earlier this month.

Police are still searching for 10 others linked to the crime.
