PRETORIA - The high court in Pretoria on Friday slammed the Hawks for ignoring evidence exonerating Shadrack Sibiya, but the unit still believes it has a case against him and will proceed with it.

The court ordered that the Gauteng Hawks boss's suspension be lifted with immediate effect because it was invalid and unlawful.

Sibiya had been suspended for his alleged involvement in the illegal rendition of Zimbabwean prisoners several years ago.

Judge Elias Matojane said Sibiya was cleared of any involvement in the illegal rendition.

"The Ipid has advised applicant in writing that it did not recommend that he should be prosecuted or suspended due to lack of evidence implicating him."

But the Hawks' Hangwani Mulaudzi says they couldn't disclose sensitive information to the court and believes the unit will be vindicated.

"In due, time the public will be able to know what is going on."

Sibiya is scheduled to report for duty on Monday.
