CAPE TOWN - The South African Communist Party (SACP) says Parliament needs to ensure Chapter 9 institutions like the Public Protector's office do not abuse their power.

The party was reacting to the Western Cape High Court ruling regarding embattled South African Broadcasting Corporation (SABC) Chief Operations Officer (COO) Hlaudi Motsoeneng, in which the court detailed some of the Public Protector Thuli Madonsela's recommendations.

The SACP says that while Madonsela's findings should be respected, they are not legally binding.

The party's Alex Mashilo says the Public Protector has been misrepresenting the powers of her office.

"What the Public Protector and other organisations have been saying all along is not true, particularly that her findings are binding unless reviewed by the court of law."

But Mashilo says the party however agrees with Madonsela that Motsoeneng should be disciplined for lying about his qualifications.

"We have said as the SACP, in the first place, the procedure and process was not followed properly looking into the appointment of Motsoeneng."

The party has also called on SABC board chairperson Ellen Tshabalala to come clean about her qualifications, saying she is wasting everyone's time.
