JOHANNESBURG - The Democratic Alliance (DA) said its newly sworn in Member of Parliament (MP) and national spokesperson Phumzile van Damme was misled by her mother about her nationality.

But it said reports that she is a Swazi national are being studied by the party's legal team.

The Sunday Times revealed that van Damme is not South African, despite this being a requirement for election to the National Assembly.

The paper reported she was in fact born and raised in Swaziland but the DA's parliamentary leader Mmusi Maimane said she can't be held liable.

Maimane said the party suspects van Damme was misled about her nationality by her parents.

"If her mother gave her false information that can't be held against disrespecting MPs."

The party's Parliamentary leader said the DA's legal team is looking into the ramifications of the revelation, but believes van Damme should be afforded an opportunity to apply for citizenship.

"She's within her rights to be guaranteed citizenship."

The report accused her of being a fraud and liar and claimed she's been avoiding questions about her birthplace for the past two weeks.
