'Mdluli should be recharged'

JOHANNESBURG - The North Gauteng High Court has overturned the National Prosecuting Authority (NPA)'s decision to withdraw charges against former Crime Intelligence head Richard Mdluli.

The application for a review and setting aside of criminal charges and disciplinary action was brought about by lobby group Freedom Under Law (FUL).

FUL's Johann Kriegler says this means Mdluli should be recharged for the murder of Oupa Ramogibe.

"The North Gauteng High Court has set aside the decision not to prosecute General Mdluli on violence, kidnapping and the likes relating to his term of office at the Vosloorus police station."

Kriegler says he is thrilled by the court's decision.

"It is very gratifying not only because it has reinforced our confidence in the South Africa judicial process, it is of reassurance to us that our reading of the law is not at fault."
