ConCourt to hear farm eviction case
ConCourt will hear argument on whether a farm owner is allowed to evict the family of his ex-employee.
JOHANNESBURG - The Constitutional Court will hear argument on Tuesday, on whether a farm owner is allowed to evict the family of a woman who used to work for him.
The owner said he needs the cottage to accommodate another employee who currently lives some distance away from his farm.
The case could set a precedent about the rights and obligations of farmers and occupiers under the Extension of Security of Tenure Act.
The adult children of a woman who lives on a Stellenbosch farm where she used to work moved into a cottage next to hers several years ago.
Now the farmer said he needs the unit.
But the woman said she has the right to a family life and thus her children cannot be evicted.
The farmer is not asking her to leave.
