Simelane to fight application
Menzi Simelane will fight an application in the Constitutional Court.
JOHANNESBURG - National Prosecutions boss Menzi Simelane's lawyers will tell the Constitutional Court on Tuesday, the Supreme Court of Appeal (SCA) was wrong to label his appointment irrational, inconsistent with the constitution and therefore also invalid.
The Democratic Alliance (DA) won an earlier application, after claiming that Simelane was not a fit and proper person to hold the position.
The Ginwala Commission found that he had tried to mislead it during the Vusi Pikoli inquiry.
Simelane's lawyers will be joined by those of the Justice Department, as they argue against the DA's application.
Simelane claimed the SCA was wrong to find President Jacob Zuma's appointment had to be reasonable and procedurally fair.
The Justice Department said the court interfered with the powers of the president.
This is seen as a crucial case amid suggestions from senior African National Congress members that the courts have too much power.
