The Supreme Court of Appeal in Bloemfontein will on Tuesday rule on the Democratic Alliance's bid to get the record of the decision to drop criminal charges against President Jacob Zuma.
The move was made in 2009 by then acting National Director of Public Prosecutions, Mokotedi Mpshe, before Zuma was elected as President.
The DA wanted a review of the decision to drop charges against Zuma.
It also wanted the NPA to produce the record of proceedings in respect to the move.
The NPA has refused to do so, questioning the DA's standing on the matter.
In 2011 the High Court ruled in favour of the prosecuting authority, but granted the opposition party leave to appeal.
The DA now wants the Appeals Court to give it legal standing to obtain the records from the NPA.
