Lawyers for Human Rights on Friday said many foreign nationals are being detained illegally at the Lindela Detention Centre, in Krugersdorp. The organisation was releasing a report on conditions at the facility.

It found that there are serious irregularities in the way the Home Affairs Department is holding and deporting those who are in the country illegally.

In many cases, people have been detained even though they were able to prove their identity and had the necessary permits. The report also cited incidents where South African citizens were held.

The organisation’s Gina Strydom said they have had no choice but to go to court to force Home Affairs to pay attention to the plight of detainees.

“The response we have had from the Department of Home Affairs is that they feel that they are under barrage of litigation. This is problematic because instead of attacking the individuals that bring court applications, it should be following strict adherence to its legal obligations,” said Strydom.
