Wouter Basson will approach the North Gauteng High Court on Tuesday to stop the Health Professions Council of South Africa from prosecuting him.
The council is investigating Basson’s conduct while he was the head of the apartheid regime’s chemical and biological weapons programme. The HPCSA is looking into six charges of unethical or unprofessional conduct.
Basson approached the high court last month asking that the hearings be found unlawful, unreasonable and unfair. But the judge found that there was no reasonable evidence to suggest that the council’s Professional Conduct Committee was influenced to be biased or prejudiced against the doctor.
He also found that Basson’s apparent fear to appear before the committee was unwarranted or unjustified.
