Movement for Democratic Change member Roy Bennett had still not appeared in court in <?xml:namespace prefix="st1" ns="urn:schemas-microsoft-com:office:smarttags"?><place w:st="on"><city w:st="on">Mutare by Monday afternoon.

He was due to appeal at 10am on Monday to answer charges of sabotage.

Bennet maintains he is innocent.

His lawyers said the appearance would be delayed because prosecutors had to come from <place w:st="on"><city w:st="on">Harare.

Bennett turns 52 on Monday.

He could hardly have been expecting to spend his birthday like this.

There were hundreds of MDC supporters gathered outside the court and high-ranking MDC officials, including the mayor of Mutare and the deputy mayor.

Police were maintaining a heavy presence.
